use trade mark for NAMES, LOGOS, and otherthings that cant be copyrighted.
NOTE: take LOTS OF MONEY!

If you want more info, try the graphic Artists guild web site. Most of the info is in the book ( I live by this book) Pricing and Ethical Guidelines

They have buttloads of info pertaining to artists rights and the such.
Great stuff.

Zap,
Similar to copyrights, one can have a certain amount of commonlaw rights to a mark. The amount of right to a mark you have is based on how and where you used it.
So, it does take money to file a trademark, but filing doesn't necessarily give you allot that you don't have already. However, to have a trademark "registered" so that you can use the circle"r", you have to file.
