Don't get too worked up about it:
Quote: |
There's a bunch of FUD going around the internets today about orphaned works, thanks to this article by Mark Simon of Animation World Network. He's urging artists to write their Congresscritters about eeeeevil orphaned works legislation and screaming about how it will effectively invalidate copyright for everyone except big evil registrars.
The problem? There is no such legislation before Congress (there was a bill in 2006, but it was never voted on; Marybeth Peters of the Copyright Office recently spoke before a subcommittee, but that's not a bill), and Simon is flat-out wrong about every concern he raises. |

We wait until the bill is presented and then read it. |

There may not be a legislation on the table, but before such legislation gets on the table it needs support. This support comes from big fat lobbies with lots of money. Information gets out early usually in forms of blurbs from interviews, articles and quotes by people connected to the lobbies.
This is also a stage when someone on the web picks it up and writes about it. Being how there is no concrete legislation on the table its easy to refute at this time.
In general yuppies and cool stylish hipsters laugh and ridicule any early warning they get, until it is proposed and passed by the government as law and then they accept it as reality and voice their support for it.
Thanks for posting about this eyewoo. Would be interesting to see if anyone else publishes anything about it.
p.s.
Reminds me of the same blind eye anti-activism that surrounded CFR and their agenda for NAU and Amero a few years ago.

Did you just call us yuppies and cool stylish hipsters that laugh and ridicule any early warning they get? j/k
I classify myself more as a cautious person that isn't quick to believe every story our shock-based biased media feeds us. People overreact, don't research information, and absorb propaganda instead of facts.
There's great info about the actual legislation here:
http://darkwing.uoregon.edu/~csundt/copyweb/
A link to the ACTUAL BILL in the library of congress:
http://thomas.loc.gov/cgi-bin/query/z?c109:H.R.5439:
:::::::IF YOU READ ANYTHING, READ THIS:::::::::::::
Here is another informative bit of information describing what's happening:
http://www.sourcewatch.org/index.php?title=Orphan_works_legislation
According to that, it's had no movement since March 2007.
So, you have the collection of OFFICIAL transcripts and documents, and Congresspedia, which is an excellent source to find info about what Congress is doing without scouring the A.P., or you can listen to people yakking on blogs.
The last bit of published public information about the bill I can find is dated 2006, if that gives anyone any indication as to how freaked we should be. If you read it carefully, you'll find it doesn't apply to work younger than 30 years old, and even then there are technicalities in the favor of the artist.
But I agree with Drunken Monkey, being complacent and not paying attention is a terrible thing. |

"Today the House and Senate sent us draft copies of the new Orphan Works Act of 2008."

Oh I just noticed that Illustrators Partnership of America is located just 20 min. away.
Maybe I should drive over there and tell them that those illustrators need a graphic designer to enlarge the font on the web site. |

Good research Jim.
I read the bill.
And i derive this scenario from this. An artist paints a painting. Its beautiful, intriguing, shocking, whatever... he takes a 7 year sabbatical to Tibet. He comes back, and realizes that Coca Cola has used his image in their national campaign that generated billions of new revenue. He sues COKE and gets $150,000 as maximum compensation.
This sounds almost exactly like the oil industry fines. Billions made, thousands paid to the small people (aka you and i).
The "searchable database" of registered works again sounds like something you will be required to get into to be able to have the "good faith" search happen. Who controls this database? How much will they charge? Every time power gets consolidated like this hair on the back of my neck stands up. They change their mind tomorrow, and you the little guy can do jack shit about it.
To make this short. As it stands right now, if you made it you own it. This legislation attacks that right. Again giving various venues to limit the responsibility of the thief.
The whole legislation is of course sold to you as something positive. Its "to save the art" and "enrich the culture". And again, the most important part to see between the lines of this draconian bill is the agenda behind it. I really hope that none of you in support of this really bought the altruistic bullshit accompanied by obvious fucking power grab. Some executive corporate mobster saw an opportunity to generate more profit by cutting costs associated with royalty payments to the little guy and we get this bill. Gift wrapped in the typical altruistic "save the <blank>" lie.
And looking ahead it seems like an even more sinister move to discourage artistic expression since it will become unprofitable. I can tell you why this is in my opinion part of the agenda here too, but thats another discussion in which i will likely draw more fire than i have time to handle at the moment.

What i was trying to convey that there is this prevailing attitude today of shooting down different and unpopular opinions with ridicule just to look cool to the surrounding crowd. Like the link above to some fucking blog by some fucking guy with the "oh don't bother me with your lamenting i got better things to do, talk to the hand ta-ta" attitude.
I wasnt trying to be cute with that statement, it really bothers shit out of me when i encounter this.
Anyway. I completely oppose this bill. Will be writing to senators and congressmen in next couple of days. I hope others do the same.
