I got this question on something and it's bugging me i can't get it... anyone with a good answer?

Two brothers were walking down the street. One said to the other, "There is that lousy Joe Brown, I hate him and have been waiting for a chance to kill him." He then walked up to Joe Brown, drew a gun and shot him dead.

At his trial, he was convicted of murder in the first degree. A few days later, at his sentencing, the Judge said, "As bad as this crime was, I am going to let you
go free, because the innocent cannot be punished for the sins of the guilty.

Why did the Judge come to this decision?

1) Because it's the brother who didn't kill him, but suggested it, on trial.

2) Because the brother was Joe Brown, so he committed suicide.

3) The brothers were twins so he could not tell which was which.

4) Joe Brown was a real dick that the judge hated.

5) Joe Brown was a cop, and, as you know, everyone likes it when you kill a cop.

6) The judge is high.

7) The judge is the murderer's brother, so he's protecting him.

8) The murderer is the judge. See #7.

9) The judge is possessed by a demon.

10) The judge is gay and thinks that the defendant is gorgeous. So, he made him a deal that if he got off, so would the judge.

11) The judge is the brother of the murderer, but they happen to be siamese twins. So he lets him go because separation is impossible and the judge doesn't want to get raped in prison.

12) The judge heard the voice of God in his head telling him what to do.

13) It was all a dream.
